What is a Confidentiality Agreement?
A Confidentiality Agreement refers to an agreement about how to share sensitive information safely. These agreements ensure that the person or organization who is provided access to sensitive information doesn’t disclose it to a third party. In transcription, this means your recordings are not shared on the ‘cloud’, including transferred onto ‘AI’ driven automated speech-to-text software or stored offshore to be worked on by non-Australian-based team members. It is important to note that privacy breaches can occur ‘intentionally’ or ‘accidentally’, and the agreement should aim to safeguard against both of these occurrences.
Why USE THIS AGREEMENT?
A lot of confidentiality agreements we see are quite simple and constitute a signed handshake around not sharing information with others. These simple agreements are sometimes combined with some general statements about deletion. These tend not to do a good job of defining what the issues and exceptions are and are more often than not, not legally binding.
This agreement on the other hand, is based on the standard one-way NDA developed by the Australian Government Intellectual Property Office Online NDA Generator. This government office is responsible for overseeing IP rights and laws in Australia. Is legally binding and is based on actual case law.
We have chosen to use this agreement to maximise transparency and trust in our security and confidentiality processes. It is an Australian relevant contract developed by a neutral authoritative party (not a lawyer employed by us). We have added some details about our particular infrastructure and system e.g. use of Australian-based servers, encryption etc.

Duration – The NDA is valid indefinitely.
This agreement covers clients indefinitely for transcription projects with us (you don’t need to fill one in every time you make an order). We are bound to protect your data – indefinitely.
